Food and Agricultural Import Regulations and Standards Report
This report provides an overview of the Chilean Sanitary Regulation of Food (RSA by its name in Spanish) currently in force. There are no major updates except for a modification of the maximum level of gluten allowed to label a product as “gluten-free” from 3 to 5 milligrams per kilogram (mg/kg) of the final product.

This report updates import certification requirements that companies need to export their agricultural products to Chile. Since the last FAIRS Export Certificate report was issued by FAS/Santiago in 2015, Chile granted access for U.S. breeding swine. Please refer to the Live Animals section for an update on those certification requirements.

Chile : Food and Agricultural Import Regulations and Standards - Narrative
On June 27, 2016, Chile’s Ministry of Health’s (MOH) new Nutritional Labeling Law came into force. Products that exceed the MOH’s set limits of sugar, salt, saturated fats and calories are required to put a label in the shape of a stop sign on the front of the package and are prohibited from advertising or marketing those products to children under 14 years of age (please refer to Section V, Labeling Requirements for more information).

Chile : Food and Agricultural Import Regulations and Standards - Certification
Since the last Export Certificate report was issued by FAS/Santiago in 2014, Chile has granted access for the following products from the United States: live cattle, bovine embryos, and horses returning after temporary stay in the United States, porcine semen and fresh pork meat. Samples of the new certifications can be found in the appendix.

Chile : Food and Agricultural Import Regulations and Standards - Narrative
On June 26, 2015, the Ministry of Health published in the Official Gazette the new regulation for the Nutritional Labeling of Food. The final decree requires, among other things, a label (or labels) on the front of prepackaged food and beverages, in the shape of a stop sign if the item exceeds certain thresholds for saturated fat, calories, sugar, and sodium. One label will be required for each nutrient that exceeds the threshold. Therefore, one product could bear up to four labels covering anywhere from 18 to 42 percent of the package face.

Chile: Food and Agricultural Import Regulations and Standards - Certification
The Ministry of Health published on June 26, 2015 the implementing regulation to Law 20606 that regulates the labeling of the nutritional compositions of food products, Decree 13, 2015. The Decree aims at targeting food product that are intended for consumption by children under 14 years of age if they exceed specified limits of sodium, sugar, energy (calories) and saturated fats.

Since the last Export Certificate report was issued by FAS/Santiago in 2013, a new protocol for equine was added for their temporary entrance into Chile, which was negotiated during 2014. The protocol and sample certificate can be found in the Appendix section of this report. In addition, the Certificate of Legal Origin for Fishery Products and Certificate for Lobsters, which are issued by NOAA can also be found in the appendix.

Chile Food and Agricultural Import Regulations and Standards - Narrative
Imports and certifications procedures implemented by the Agricultural and Livestock Service (SAG) of the Ministry of Agriculture obtained ISO 9001 certification in June 2013. Under this new inspection scenario, inspectors have little room for discretionary decisions and full enforcement of the law is required at the ports of entry.

Food and Agricultural Import Regulations and Standards - Certification
New certification for one-day birds and fertile eggs was negotiated during 2010, see sanitary requirements in Appendix II; new sanitary certification for bovine semen was put out for public comments in the WTO, deadline has finished and we are waiting for the last version, update will be posted in APHIS website when notified; Chile and the United States are negotiating new certificates for frozen/chilled/processed pork and bovine meat, until such process is finish, the declarations given on this report are valid, see Animal product section, page 17 and 18.
