Food and Agricultural Import Regulations and Standards Report
In March 2018, the Chinese Government underwent a reorganization, which consolidated food safety responsibilities into the State Administration for Market Regulation (SAMR), the General Administration of China Customs (GACC), and the Ministry of Agriculture and Rural Affairs (MARA). China continues to update national food safety standards, some of which were issued in 2009, to align them with the 2014 Food Safety Law and other regulations.

China Implements Supplemental Imports Tariffs on U.S. Products Exported to China
On September 18, 2018, China’s State Council Tariff Commission (SCTC) announced that it would start enforcing additional import tariffs on U.S. products exported to China valued at $60 billion (“the Supplemental Tariffs”). This round of Chinese tariffs was first announced on August 3 in response to the U.S. announcement of a proposed $200 billion in additional tariffs and was reported in GAIN Report CH18043. The proposed Supplemental Tariffs were originally divided into four schedules, each with a different tariff rate (25, 20, 10, and 5 percent). In the September 18 announcement, SCTC combined Schedules 1 and 2 and set the tariff rate at 10 percent for both; Schedules 3 and 4 were also combined at a tariff rate of 5 percent. There are a number of food, agricultural, and agricultural-related products across these schedules. The Supplemental Tariffs went into effect on September 24.

China to Cut Tariffs on Agricultural Products
On July 1, China will cut most-favored-nation (MFN) tariffs for 1,449 taxable items, including several agricultural and seafood items. The tariff reductions include 388 food and agricultural related products such as seafood, processed meat, processed vegetable, sauces, and snack food products. The announcement will impact Chinese food agriculture related imports from the United States with an estimated value of $1.9 billion in 2017, and lower average tariff rates from 15.2 percent to 6.9 percent. U.S. exporters should be aware of the new tariffs and check with local importers to verify changes in their tariff rate.

After a fourteen year hiatus, in 2017, China reopened its market and issued new procedures allowing U.S. beef imports. In November 2017, China also reopened the market for U.S. live horses. Although proposed, no significant changes in Chinese export certificate requirements occurred in 2017. Food and Agricultural Import Regulations and Standards - Narrative
China’s food regulatory regime continues to evolve. In 2017, China issued numerous new regulations and measures to reflect the requirements introduced under the 2015 Food Safety Law. Most notably, China notified a revised draft of the Regulations for the Implementation of the Food Safety Law in August 2017. As part of these implementation efforts, China notified revisions to inspections and quarantine regulations (AQSIQ Decree 144) in September. China issued technical documents and guidelines to implement registration requirements for special foods (CFDA Decrees 24 and 26). Similarly, in 2017, China announced plans to develop standards for limits on agrochemicals residues. Starting January 1, 2018, China is expanding the application of Cross Border E-Commerce (CBEC) policies on imports to five more cities: Hefei, Chengdu, Dalian, Qingdao and Suzhou. Lastly, also in 2017, China reopened its market and issued new procedures allowing U.S. beef imports.

Christmas Comes Early as China Announces Annual Tariff Reductions on Select Consumer Products
China announced its annual tariff revisions a month early this year, with tariff reductions on select commodities set to become effective on December 1, 2017, instead of the usual January 1, 2018 timeline. Further tariff revisions for 2018 are not anticipated at this time. In addition to the earlier timing, this year’s revisions were notable in that they primarily focused on middle-class consumer products, such as processed cheese, fresh and dried fruits, nuts, and certain types of infant formula.

Major changes in 2016 include China’s implementation of new registration requirements on grains and oilseeds (AQSIQ Decree 177) and live seafood (AQSIQ Decree 183). China also introduced registration requirements for infant formula recipes (CFDA Decree 26), health foods (CFDA Decree 22), and foods for special medical purposes (CFDA Decree 24). In addition, in 2016, China granted market access for California strawberries and U.S. sugar beet pulp.

During 2015, on the backdrop of continuous food scandals and rising consumer concerns, Chinese food regulators continued the onerous task of regaining consumer’s trust by revamping China’s Food Safety Regime. Over the past two years, China has reviewed and issued thousands of new food safety and hygiene standards. Most notably, China’s 2015 Food Safety Law came into effect on October 1. In addition to specific implementing rules, a series of regulations, rules, and measures will be issued to carry out the provisions of the Law.

China : Food and Agricultural Import Regulations and Standards – Subject Report
China is in the process of implementing a revised regulatory and registration system for imported feed and feed additives. Under this system, companies need to complete the following three steps before they can export feed ingredients or additives to China: 1) obtain an import registration license from the Ministry of Agriculture (MOA), 2) apply for market access with the General Administration for Quality Supervision, Inspection and Quarantine (AQSIQ), and 3) have their manufacturing facility be registered by AQSIQ. This process can include an audit, which China requires the exporter to pay for.

On June 4, 2012, China notified the WTO of National Food Safety Standard: Grain as SPS/N/CHN/525. This standard applies to raw grains and grain products for human consumption, including cereals, beans, and potatoes. This standard does not apply to raw materials for the manufacture of edible oil. National Standard of Seed Potatoes (Draft for Approvals)
On July 18, 2012, China notified the WTO of National Standard of Seed Potatoes as G/TBT/N/CHN/920. The standard was drafted for regulating the production of seed potatoes, maintaining seed potato trade order, promoting supervision and administration, and protecting the benefits of farmers. The date for submission of final comments to China is September 16, 2012. The proposed date of adoption of the standard is 90 days after its notification to the WTO, and date of its entry into force is 6 months after the notification.

Regulation on Feed and Feed Additive Import Registration (Amended Draft for Comments)
On March 1, 2012, China's Ministry of Agriculture (MOA) published a Notice on “Regulation on Feed and Feed Additive Import Registration (Amended Draft for Comments)” for public comments, which are due on March 31, 2012. This draft regulation replaces the current “Regulation on Feed and Feed Additive Import Registration (enforced on August 17, 2000),” and provides further details on Decree 609 (CH12008).
