FSSAI to let FBOs renew expired licence with one time penalty.

The Food Safety and Standards Authority of India (FSSAI) has decided to let food businesses renew their expired licence with a one time penalty in place of a recurring per day penalty post expiry date.
However, the window for renewal of licence would only last 180 days after the expiry date.
The order passed by the food authority says that Food Business Operator can renew the FSSAI Licence/Registration even after expiry date with penalties including - three times of the existing annual licence/registration fee in the period – 1st day to 90th day from the original expiry date and additional two times of the existing annual licence/registration fee (i.e., total 5 times) in the period – 91st day to 180th day from the original expiry date.
The FBOs will not be allowed to renew the licence after 180th day after their licence has expired and this provision of filing renewal application after the expiry date shall be subjected to online submission of due Annual Returns through FoSCoS (Food Safety Compliance System) by the licensed food manufacturer or importers.
Also, 'FBOs shall not be allowed to conduct any food business in the period from original expiry date till the issuance of renewed licence. Any food business conducted in such period will be subject to the penalties and punishment as per Section 63 of FSS Act, 2006,' reads the order and adds that the fresh validity date will be generated on the grant of renewed licence/ registration while the policy shall be valid till the date of implementation/ operationalisation of FSS (Licensing and Registration of Food Businesses) Amendment Regulations, 2021, as notified by the food authority.
Further, the order added that this policy shall commence with immediate effect, i.e., FBOs whose licence/registration has expired within the last 180 days from the date of issuance of this order, can avail the policy and apply for renewal of Licence/Registration through FoSCoS.
According to the FSS Act, the FBOs need to apply for renewal of licence as early as 30 days prior to the expiry date mentioned in the licence. In case, renewal of licence was not filed till 30 days prior to the expiry date, a late fee of Rs 100 per day to be paid by FBO along with the renewal fee.
An official with the FSSAI said that due to the prevailing Covid-19 pandemic in the country, the instances have increased where many FBOs have failed to renew their Licence/Registration in the provided time. They were required to obtain fresh Licence/Registration to continue their food business. This resulted in redoing the complete procedure for obtaining licence/registration, circulating the new licence/registration number across all trading food businesses, loss of pre-packaged printing material etc. Therefore to facilitate the food businesses to continue with the same licence number even after expiry date, the order was issued.
